1. Services Description

AIQ provides AI-powered imaging solutions including but not limited to Perma-AI photographic models, AI photoshoots and videos, Celebrity Digital Twins, Personal Image Preservation, and other custom AI imaging solutions as described on our website.

2. Account Registration

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

You are responsible for safeguarding the password that you use to access our services and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

3. Intellectual Property

Our services and their original content, features, and functionality are and will remain the exclusive property of AIQ and its licensors. Our services are protected by copyright, trademark, and other laws of both the United Kingdom and foreign countries.

The specific rights to AI-generated content created through our services are outlined in our Licensing & Intellectual Property section. In general:

• For Perma-AI models and AI photoshoots, clients receive full commercial usage rights to the generated content, while AIQ retains ownership of the underlying technology.
• For Celebrity Digital Twins, usage rights are determined by the specific agreement between AIQ, the celebrity, and the client.
• For Personal Image Preservation, individuals maintain complete ownership and control of their digital likeness.

4. User Content and Conduct

Our services may allow you to upload, submit, store, send, or receive content. You retain ownership of any intellectual property rights that you hold in that content.

When you upload, submit, store, send, or receive content through our services, you give AIQ a worldwide license to use, host, store, reproduce, modify, create derivative works, communicate, publish, publicly perform, publicly display, and distribute such content solely for the purpose of providing and improving our services.

You agree not to use our services:

• In any way that violates any applicable national or international law or regulation.
• To create content that is illegal, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.
• To impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
• To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of our services, or which may harm AIQ or users of our services.

5. Prohibited Uses

You specifically agree not to use our AI technology for:

• Creating deepfakes without explicit consent of the individuals depicted.
• Generating misleading political content or disinformation.
• Creating content that could harm an individual's reputation.
• Producing content that violates copyright, trademark, or other intellectual property rights.
• Generating content that promotes discrimination, hatred, or violence against individuals or groups.
• Creating pornographic, sexually explicit, or otherwise obscene material.
• Any illegal activities or purposes that violate applicable laws and regulations.

6. Payment Terms

Certain services offered by AIQ may require payment. By using these services, you agree to pay all fees and charges associated with your account on a timely basis and according to the pricing and payment terms disclosed to you at the time of purchase.

All payments are non-refundable except as expressly set forth in these Terms or as required by applicable law. We reserve the right to change our prices at any time, and to correct pricing errors that may inadvertently occur.

7. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use our services will immediately cease. If you wish to terminate your account, you may simply discontinue using our services or contact us to request account deletion.

8. Limitation of Liability

In no event shall AIQ, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use our services;
• Any conduct or content of any third party on our services;
• Any content obtained from our services; and
• Unauthorized access, use, or alteration of your transmissions or content.

9. Disclaimer

Your use of our services is at your sole risk. Our services are provided on an "AS IS" and "AS AVAILABLE" basis. We expressly disclaim all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our services after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using our services.
